And desiring a Warrant to survey the same in order to obtain a Deed being ready to pay the Composition & Office Fees, These are therefore to impower you to survey the said Waste & ungranted Land for the said Henry Miars paying due Regard to your Instructions A Plot of which Survey with this Warrant you are to return to this Office on or before the 29th Day of November next...[page torn off]

"The Right Honourable Thomas Lord Fairfax Baron of Cameron in that part of Great Britain called Scotland Proprietor of the Northern Neck of Virginia To all to whom this present Writing shall come sends Greeting Know Ye that for good causes for and in Consideration of the Composition to me paid and for the annual rent hereinafter reserved I have given granted and Confirmed and by these presents for me my Heirs and assigns do give grant and Confirm unto Henry Miars of Dunmore County a Certain Tract of waste and ungranted Land near the Narrow Passage in the said County bounded as by a Survey thereof made by John Hough Beginning at 3 Pines Corner to Samuel Nizely and to Miars former Survey thence with his old line N'45 1/2 E one hundred and forty eight Poles to Several Pines his Corner and Corner to Peter Hanger then with Hangers line S'71 W' Fifty Poles to 4 White Oak saplings Corner to the sd. Hanger then with another of his lines N'5 W': one hundred and ninety Poles to 2 Pines and a White Oak Corner to Hanger and Mathias Sheets thence with Sheets line S 21 W' one hundred & seventy Poles to a small White Oak sapling Corner to the sd. Sheets & Samuel Nizely then with Nizelys line S 8 E' one hundred & Twenty Poles to the Beginning containing Eighty Two acres Together with all Rights Members & appurtenances thereunto belonging Royal Mines excepted and a full third part of all Lead Copper Tin Coals Iron Mine and Iron Ore that shall be found to have and to hold the sd. 82 acres of Land Together with all Rights Profits and Benefits to the same belonging or in any wise appertaining Except before Excepted to him the sd. Henry Miars his Heirs and assigns for Ever he the said Henry Miars his Heirs and assigns therefore Yielding and Paying to me my Heirs or assigns or to my Certain attorney or attornies agent or agents or to the Certain attorney or attornies of my Heirs or assigns Proprietors of the sd. Northern Neck yearly and every year on the Feast Day of St. Michael the archangel the Fee rents of One Shilling Sterling Money for every Fifty acres of Land hereby granted & so proportionably for a greater or lesser Quantity Provided that if the said Henry Miars His Heirs and assigns shall not pay the sd. reserved annual rent as aforesaid so that the same or any part thereof shall be behind and unpaid by the Space of Two whole years after the same shall become due if Legally --- Demanded that then it shall and may be law full for me my Heirs or assigns Proprietors as aforesaid my or their Certain attorney or attornies agent or agents unto the above granted Premises to Reorder? & hold the same so as if this grant had never Passed Given at my Office in Frederick County under my Hand & Seal Dated the Tenth Day of November 1777.

"In the name of God Amen I Henry Meyer of the County of Shenandoah state of Virginia being in perfect health and of perfect mind and memory thanks be given to God for the same calling unto mind the mortality of my body & knowing that it is appointed for all men one [day?] to die do make and ordain this my last Will & testament that is to say principally & first of all I give and recommend my soul into the hands of almighty God that gave it & my body I do commend to the earth to be buried in a decent christian burial at the discretion of my Executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God and as touching such worldly estate wherewith it has pleased God to bless me in this life I give devise & dispose of the same in the following manner and form Viz.---
First I desire that all my Just debts be first Revised? out of my movable estate and paid at the usual time of payment after my decease --
Item I give & bequeath unto my beloved wife Barbara over and above the third part of my movable estate one feather bed with furniture one Cow one Chest one Spinning Wheel & one Sheep.--
Item I do give and bequeath unto my son John Meyer the plantation whereon I now dwell with all the improvements thereunto belonging but I desire that she my widow shall have full possession of the dwelling house and that he my son John Meyer is to give her every year during her natural life and as long as she remains my Widow seven bushels and a half of wheat seven bushels and a half of rye fifty pounds pork, three gallons of whiskey fifty pound hemp ruf from the brake one pair shoe one pair soles, 1/2 bushel salt part of the garden and the quarter part of the orchard fruit likewise to winter or to keep her one horse, one cow, one sheep and provide her as much fire wood as she shall have need of and that he shall pay out of the said land after my wifes decease the sum of eighty pounds Virginia current money to be paid at five pounds a year & be divided among the rest of my seven children. Viz.? to begin the first year after my wifes decease and so on and further do I order that he shall not sell the land during my wifes life.--
Item I do order & desire that all my children being eight in number shall have each & all of them an equal share alike of my movable Estate.--
Item and further I hereby do make constitute & ordain my beloved sons Michael and John Myer or any survivor of them to be my Executors of this my last Will and testament to pay all my debts & to receive all my Just debts due to me and I hereby uterly [utterly?] disallow remove and disannul all and every other former testaments Wills, legacies bequeats [bequests?] Executors & Executrix by me in any wise named before Willed or bequeated [bequeathed?] ratifying? and confirming this & no other to be my last Will and testament. [East] one hundred and twenty poles to the Beginning Containing 82 acres more or Less/ the above tract of Land was Conveyed to the said Henry Myar by Deed of the proprietors office bearing date November 10th, 1777 and the said Henry Myer hereby Conveys the same unto the said John Myar his heirs or assigns and all houses buildings Orchards ways water water Courses profits Commodities heraditaments and appurtinances thereunto belonging or in any wise appurtaining and the reversion and -- Reversions Remainder and Remainders Rents issues and profits thereof also all the estate Right title Interest ??? trust? properly Claim? and Demanded? whatsoever of him the said Henry Myar of in and to the said Bargained Premises and of every part and parcel thereof -- To have and to hold the said Eighty two acres of Land with the appurtinances unto the said John Myar his heirs and assigns forever to the only proper use and behoof [behalf?] of him the said John Myar his heirs or assigns forever and the sd. Henry Myer doth Covenant and agree to and with the said John Myer his heirs and assigns that he the said -- Henry Myar is seized of a good sure perfect and Indefeizible [indeviseable?] Estate of Inheritance in fee -. Simple of in and to the said premises hereby bargained and sold and that he has good power and Lawful and absolute authority to grant and Convey the same to the said John Myars in manner & form? aforesaid and also that the said John Myar his heirs or assigns shall and may at all times hereafter peacibly [peaceably?] and quietly occupy possess and Enjoy the said Bargained premises with the -- appurtenances unto him the said John Myar his heirs & assigns without the least trouble Hindrance Molestation or Interruption of him the said Henry Myar his heirs or assigns and of all and every other person & persons Whatsoever Claiming by from or under him them or any of them and further that he the said Henry Myar his heirs and assigns shall and will from time to time and at all times hereafter at the Reasonable Request and at the proper costs and Charges in the Law of him the Said John Myar his heirs or assigns make do and Execute or cause to be made done and Executed all and every such further and other reasonable act and acts thing and things device & Devices in the Law whatsoever for the further better and more perfect Conveying and assuring all and singular other the premises hereby bargained and sold with the appurtinances unto the said John Myer his heirs and assigns forever.
